General selling conditions
Orders
All orders are intended at booking title and do not bind our company to delivery, even if partial. Orders, for company customers, will be accepted and despatched only if in an amount exceeding 1000 €.
Prices
Unless otherwise specified and only after written approval, valid prices list are those in force at the time of delivery or despatch except for different agreement. Prices are meant for goods delivered EX WORKS.
Shipments
Goods are usually carried EX WORKS, unless otherwise agreed. Goods are carried at buyer's risk and danger even if sold free destination.
Paymnts
Payments conditions are those shown in the invoice and are binding. At the agreed expires, without any notice, interests on delayed payment will be calculated according to the practiced average banking rate at the expiry date. Any draft or payment fees will be at full client's charge.
Claims
Claims are not accepted after 8 days upon goods receipt.
Claims must be issued in writing and sent to our headquarters.
Returned goods
Returned goods are not accepted without our previous authorization. The authorization must be released in writing and, in any case, goods shall be returned free destination. Suspension of orders and force majeure. In the buyer does not comply partially or in full with our sales conditions, our company can suspend further deliveries. Our company is exempt from the implementation of obligations deriving from the sales contract in whatever case of force majeure.
Modifications
Our company retains the right to apply whatever modification to our products in view necessary, without any previous notice, in any moment and for any reason.
Competent jurisdiction
In case of controversy the only competence of the Court in Brescia is recognized.
Guarantee conditions
Any NTM spa product is covered by a two-year warranty from the delivery date from our factory. In case of material defects, or hidden faults, as well as mistakes or differences in dimensions exceeding normal manufacturing tolerances, NTM spa will only replace the faulty pieces. Any eventual return of goods will be accepted only against a prior written authorization of NTM spa Commercial Directors. In any case, the returned gods shall have to reach NTM spa warehouse free of any transport costs; on the contrary, the goods will be rejected and returned to the sender.
NTM spa will take care of any eventual operation for retur and replacement of goods only in the case that NTM spa responsability for a mistake in production or order execution is proved. Any eventual return of goods must be agreed with the Sales Manager of NTM spa. Customers have to pay for freight costs. In case NTM spa installed faulty products accidentally cause damages to things or people, NTM spa will call upon his Insurance Company to treat the accident according to the policy. To this aim NTM spa must receive a specific questionairre duly filled in with all the accident details, pictures of the faulty articles taken in the accident place and one or more samples of faulty articles.
The Insurance coverage lasts ten years from the delivery date from our factory. No reimbursement will be allowed until NTM spa has verified the cause of the claim/damage. NTM spa reminds its Custumers and assemblers they have to perform and register tests on the installed system according to International Standards and/or National Laws. The assembling/mounting processes must be strictly in compliance with the instructions included in the Tecnical Catalogues published by NTM spa.
Sealing guarantee
NTM S.p.A., a manufacturer of fittings, valves and pipes for use in domestic heating and water systems, by means of a dedicated insurance policy underwritten by a major insurer issues the following:
SEALING GUARANTEE
(valid for 10 years)
from the supply date due to direct material or production defects covering:
- THE INSTALLATION COSTS OF THE REPLACEMENT PARTS
- COMPENSATION FOR DAMAGE CAUSED TO PERSONS OR PROPERTY UP TO
€ 500.000,00
For each individual claim and in any case up to a maximum of
€ 1.500.000,00
per year also in the event of more than one claim.
- This guarantee only covers the material found to be defective. The defect must be notified to the manufacturer as soon as it is found and must be subjected to the manufacturer’s inspection. Products with obvious defects should not be installed but returned immediately to the manufacturer.
- The product must be installed according to the instructions given in the installation leaflet and likewise the conditions of use must comply with those prescribed.
- The guarantee is not limited to the installation of pipes supplied by NTM, but in particular is also extended to all multi-layer pipes on condition that:
- They must be in one piece and not damaged, not deformed and circular in shape.
- Pipes must conform to UNI 10954 standard.
- Pipes must comply with the dimensional specifications given in the technical manual.
- This guarantee is not valid for:
- Faults caused by incorrect installation and laying.
- Faults caused by tampering by third parties during installation, transportation, assembly or delivery on site.
- Faults caused by incorrect use.
- This guarantee applies to press fitting systems with TH-U · H · B · F · RF type cheek plates.
This guarantee applies to installing fittings from NTM S.p.A. in connection with any brand name multi-layer composite pipes provided they comply with the above specifications..
Quality declaration
The Company NTM spa manufacturer of parts for heating, sanitary and gas systems, located in Brandico (BS) – ITALY Via John Maynard Keynes, 15/17 according to the Ministerial Decree D.M. 37/08 dated 27/03/2008 “Regulations about reorder of laws regarding the activities of installation of systems inside building”
DECLARES
that all products distributed to Customers are designed and produced according to actual technical standards and according to Quality requirements stated in EN ISO 9000 international standard. The good quality of NTM spa products and the entire production process is recognized by certification UNI EN ISO 9001:2008 and BS OHSAS 18001:2007 that attest the seriousness held in development, manufacture and marketing of NTM spa products along with the constant attention to compliance with health and safety of all employees.
